Stragus: that's a huge it-depends,
particularly with respect to whatever agreement you have with
SURVICE. if you don't have something saying otherwise, using
personal code for work can result in a transfer of ownership to an
employer. if that has occurred, as opposed to some irrevocable
worldwide unlimited license use, then you would not be able to sell
it to this new 3rd party. I would recommend |
15:22.40 |
brlcad |
against that anyways as people with that
mindset are likely to want to exercise their ownership, otherwise
they wouldn't ask for that. |
15:23.54 |
brlcad |
If you want to sell and think you still have
rights to do so, you could offer them a non-exclusive license (not
copyright transfer) |
15:25.43 |
brlcad |
Stragus: if you can't put a standard flexible
license on it (like apache2 or mit etc) and be done with it, that
would be highly suspicious.. |
15:31.29 |
Stragus |
brlcad: I have an agreement with SURVICE, I
often bring in personal code, I keep the copyright and both SURVICE
and U.S. government gets
unlimited/unrestricted/perpetual/transcendental rights |
15:32.34 |
Stragus |
I don't really want to sell anything, the guy
just wants to bring the code in his project, and he wants uniform
copyright over all the code for reasons |
15:35.09 |
Stragus |
And he says I would still get
unlimited/unrestricted rights to the code, so I could keep using it
anywhere (even in SURVICE and elsewhere?...) |
15:35.17 |
Stragus |
Also, argh, what a mess |

Stragus: I wouldn't without consulting a
lawyer for those reasons. smells fishy under guise of "he just
wants ... for reasons". well you just want to keep copyright for
... reasons too. let him have unlimited unrestricted rights.
unless he's offering you a very large pile of cash and you're okay
with the worst case happening (e.g., he sues you for using his
code) |
16:23.32 |
brlcad |
you could very easily accidentally agree to
revocable rights, so you can keep using it today anywhere, but
maybe not tomorrow |
16:25.25 |
brlcad |
he could even in good faith give you proper
unlimited rights and then deliver/sell the code to some other
company who might then sue you for infringement. You'd win the
lawsuit, of course, just after going bankrupt defending
yourself. |
